By accessing or using arlingtonalpha.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use this Site. Arlington Alpha LLC ("Arlington Alpha," "we," "us," or "our") reserves the right to modify these Terms at any time. Continued use of the Site following any modification constitutes acceptance of the revised Terms.
2. Nature of the Site and Services
The Site provides operational performance analysis, strategic resilience auditing information, protocol documentation, and lead generation tools for senior executives and professionals in the DC metro corridor. All content is strategic and operational in nature.
Arlington Alpha does not provide:
- Clinical medical advice, diagnosis, or treatment
- Licensed psychiatric or psychological services
- Financial or investment advice
- Legal counsel
- Pharmaceutical recommendations or prescriptions
The Executive Decision-Fatigue Audit, performance briefs, and protocol documentation available on this Site are for informational and operational planning purposes only. They are not substitutes for consultation with qualified licensed professionals in medicine, psychiatry, finance, or law.
3. Intellectual Property
All content on the Site — including but not limited to text, graphics, KPI frameworks, protocol documentation, the KPI Translation Engine methodology, brand assets, and the "The Alpha Protocol" and "Arlington Alpha" names and marks — is the intellectual property of Arlington Alpha LLC and is protected by applicable copyright, trademark, and trade secret law.
You may not reproduce, republish, distribute, or create derivative works from any Site content without the prior written consent of Arlington Alpha. Limited quotation for editorial, journalistic, or academic purposes is permitted provided attribution is given to Arlington Alpha and a link to the original source is included.
4. User Conduct
You agree not to use the Site to:
- Scrape, harvest, or systematically extract content, data, or KPI frameworks for competitive or commercial redistribution
- Submit false, misleading, or fraudulent information through any Site form or intake tool
- Attempt to reverse-engineer, decompile, or extract proprietary methodology from Site content
- Transmit malicious code, conduct denial-of-service attacks, or otherwise interfere with Site infrastructure
- Impersonate Arlington Alpha, Hamza Davis, or any Arlington Alpha affiliate in any communication
5. Referral Links and Third-Party Services
The Site contains links to third-party websites and services through referral partnerships. Arlington Alpha is not responsible for the content, accuracy, privacy practices, or performance of any third-party site. The existence of a referral link does not constitute an endorsement of a third party beyond the specific product or service context described in Arlington Alpha's content.

6. Audit Tool and Form Submissions
The Executive Decision-Fatigue Audit and intake forms on this Site collect information you voluntarily provide. By submitting information through any Site form, you represent that the information is accurate and that you are authorized to submit it. Arlington Alpha's handling of submitted information is governed by the Privacy Policy.
Audit results and readiness tier classifications produced by the Executive Decision-Fatigue Audit are informational outputs based on self-reported responses. They are not diagnostic assessments and carry no clinical validity. Arlington Alpha makes no warranty as to the accuracy, completeness, or fitness for purpose of any audit output.
7. Disclaimer of Warranties
The Site and all content are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Arlington Alpha does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Arlington Alpha LLC, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from or related to your use of the Site, reliance on Site content, or engagement with Arlington Alpha services — including but not limited to lost profits, lost data, business interruption, or personal injury — even if advised of the possibility of such damages.
Arlington Alpha's total aggregate liability for any claim arising from use of the Site shall not exceed the amount paid by you to Arlington Alpha in the twelve months preceding the claim, or one hundred US dollars (USD $100), whichever is greater.
9. Indemnification
You agree to indemnify, defend, and hold harmless Arlington Alpha LLC and its officers, employees, agents, and affiliates from any claim, demand, damage, liability, cost, or expense (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party right.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Arlington County, Virginia.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
